SENATOR GERZOFSKY’S BILL TO STRENGTHEN SEXUAL ASSAULT LAWS TAKES EFFECT
AUGUSTA – A law sponsored by Senator Stan Gerzofsky (D-Brunswick) to strengthen the laws concerning sexual crimes went into effect on October 8.
“There is no excuse for sexual abuse, ever,” said Senator Gerzofsky.
The law extends the statute of limitations for criminal prosecution of these crimes to ten years, and allow for an unlimited window of time for a victim to pursue a civil action. The law relates specifically to sexual acts committed by persons of authority, including teachers, employers, health care providers, and spiritual advisors.
Elizabeth Ward Saxl, the director for the Maine Coalition Against Sexual Assault (MECASA), expressed her approval of the law and agreed that it would provide protection and closure for victims of abuse.
“It is often very difficult for victims of sexual violence to come forward and report the crimes committed against them. Many times, if they come forward at all, it may take years. As a result, some victims find that, when they are ready to make a report, the statute of limitations has run.” said Saxl. “This new law is an important step in providing victims more time and as a result increases the chance that justice will be served and that perpetrators will be held accountable.”
Gerzofsky said he had worked on this issue in the legislature in the past and is thrilled that the measure was successful this time around.
“It is an abuse of power to have sex with a patient, student, employee or anyone else whom you wield any type of authority,” said Senator Gerzofsky. “This law spells that out in very plain language.”
Sue Hall Dreher, the director for the Sexual Assault Support Services of Midcoast Maine is pleased with Gerzofsky’s commitment to this issue.
“We are grateful, as always, to Senator Gerzofsky for taking on the leadership involving realities of sexual violence and this legislation is one example of strengthening Maine’s laws.” said Dreher “With the action of this bill, it gives the message that we recognize that sexual violence can, and often will, have a long term impact for the survivor.”
