Senator Chipman bill to support animal rights becomes law
AUGUSTA — Recently, a bill from Senator Ben Chipman, D-Portland, to provide for the care of animals became law without the signature of Gov. Janet Mills. LD 535, “An Act To Provide for the Well-being of Companion Animals upon the Dissolution of Marriages,” requires the court to consider the well-being of a companion animal in the ending of a marriage.
“This law will now make sure courts consider the welfare of a pet in the case of a separation or a divorce,” said Senator Chipman. “Our pets are members of our families; it only makes sense they should be provided for and that their well-being should be considered in a family separation. Maine ranks first in the United States for animal welfare, and this law will continue our legacy.”
LD 535 would provide that in the disposition of property within the legal proceedings of a divorce, the judge must consider the companion animal’s well-being. Factors ranging from financial support, instances of domestic violence, the emotional attachment of any child in the home, benefits to the child and energy devoted to daily basic needs, among others, are all to be taken in to account.
LD 535 goes into effect 90 days after the Legislature adjourns sine die.
